INTRODUCTION

The subject of the lease is the:

hereinafter “Villa Pietra”.

In order to complete the booking, guests must agree to the General Terms and Conditions of RECON ISTRIA. By booking Villa Pietra in the requested period, guests agree to these terms and conditions. After RECON ISTRIA receives the booking, an invoice is sent to the guests. The invoice constitutes a binding booking confirmation and, together with these General Terms and Conditions, constitutes the rental contract between the guests as tenants and RECON ISTRIA as landlord.

1. VILLA PIETRA

1.1. Number of guests

Only persons indicated in the guest information are allowed to stay on the Villa Pietra property. Villa Pietra has eight beds, so the maximum capacity is eight people. Children five years and older count as one person. Infants up to four years of age may be included in addition to the maximum number of guests, provided they do not require their own bed. A change in the number of guests must be communicated by email three days before arrival. If there are more persons in the villa or on the property than registered, RECON ISTIRA reserves the right to terminate the lease without notice with immediate effect. As a result, the guests will finally leave the villa within two hours. Refund for the unused period of the rental period is excluded.

1.2. Younger guest groups

If the guests are 25 years old or younger, they are considered a younger guest group. RECON ISTRIA must be informed about the age of the group before or immediately after the booking, if it is a younger group of guests. Failure to comply with this regulation may result in cancellation of the booking or termination of the lease without notice, in which case the guests will not be entitled to a refund of the rent paid.

1.3. Tents and caravans

No tents, caravans, campers, etc. may be parked on the Villa Pietra property. Should this prohibition not be retained, RECON ISTRIA is authorized to terminate the rental agreement without notice with immediate effect. Thereupon, the guests together with all the people accommodated there will finally leave the villa within two hours. Refund for the unused period of the rental period is excluded.

1.4. Pets and allergies

Pets are not allowed in the swimming pool. During the booking process the guest will specify the number of pets. The surcharge for pets is automatically added to the rental price. The number of pets in Villa Pietra must not exceed the number registered and indicated on the confirmation.

Dog owners are responsible for removing their pet’s waste. Leaving behind the remains will result in additional cleaning costs, which will be charged additionally to the guests.

Pets are not allowed on furniture at any time. Any evidence of animals on furniture may result in an increase in final cleaning charges. All pets must be vaccinated in time against rabies and all other diseases according to relevant regulations. Guests are advised to inform themselves about possible diseases of pets in the travel area and to prevent them. Guests are solely responsible for keeping pets at Villa Pietra. RECON ISTRIA is not responsible for any illnesses and injuries of pets during the stay.

Since pets are generally allowed, previous guests may have had a pet with them. RECON ISTRIA does not assume any liability for allergic reactions of guests that may occur as a result of pets.

In the event that the guest brings a pet that has not been announced, RECON ISTRIA reserves the right to terminate the rental agreement without notice with immediate effect. Thereupon, the guest, together with all persons accommodated there, will finally leave the villa within two hours. Refund for the unused period of the rental period is excluded.

1.5. Noise / Consideration

We ask our guests to be considerate of the people in the neighborhood, especially at night from 22:00 to 07:00. If the guests disturb the public peace and order with noise and do not become quieter even after a warning, this is a serious violation of the lease agreement. In this case RECON ISTRIA is entitled to terminate the rental contract with immediate effect. Thereupon, the guest, together with all persons accommodated there, will finally leave the villa within two hours. Refund for the unused period of the rental period is excluded.

1.6. Swimming pool

The guest will follow any instructions from the owner about the use of the swimming pool for their own safety. The guest is responsible in all respects for the use of the swimming pool. Children are allowed in the swimming pool area only under adult supervision. The guest uses the swimming pool at his own responsibility. If the accommodation is booked outside the summer season June-August, there is a possibility that the swimming pool can not be used.

1.7. Pool heater

Villa Pietra has a pool heating system. Pool heating can be booked additionally at the time of booking. The effect of the pool heater depends on the external environmental factors such as sunshine, heat, wind, temperature, etc.. Therefore, a certain warmth of the pool can not be guaranteed and is not owed.

1.8. House rules

The villa has separate house rules, which are posted in the villa. The house rules are thus an essential part of the rental agreement. If the guests do not follow the house rules, it is a serious violation of the lease. In case of violation of the house rules, RECON ISTRIA reserves the right to terminate the lease without notice with immediate effect. Thereupon, the guest, together with all persons accommodated there, will leave the villa for good within two hours. Refund for the unused period of the rental period is excluded.

2. ARRIVAL AND DEPARTURE

The earliest check-in is at 16:00 on the day of arrival. The latest check-out is at 9:00 am on the day of departure. Earlier arrival and later departure are not possible.

2.1. Guests registration

Guests are required by Croatian law to provide official identification documents to the villa landlord for tourist registration purposes with the National Tourist Board (HTZ). This data will not be used for any other purpose. Failure to present the required identification documents may result in denial of access to the accommodation without refund of the paid rent.

3. PRICES AND TERMS OF PAYMENT

Unless otherwise stated, all prices are in Euro per villa per week.

Upon completion of the booking process, the contract with RECON ISTRIA is concluded. The booking is binding and the selected period is blocked bindingly for the guests. After the booking process is completed, guests will receive an invoice by email or by mail. The invoice, together with these General Terms and Conditions and the House Rules, is an integral part of the rental contract between the guests and RECON ISTRIA.

The cost of water, gas and electricity consumption, internet access, bed linen, kitchen towels, final cleaning of the interior, maintenance of the pool and exterior, registration and local tax and VAT are included in the rental price.

RECON ISTRIA recommends the conclusion of a travel cancellation insurance as well as the conclusion of a liability insurance. On the homepage of RECON ISTRIA a travel cancellation insurance is offered. The insurance contract is concluded with the guest and the insurance company. The settlement and billing is done directly between the guest and the insurance company.

3.1. Bookings outside 6 weeks before the start of the rental period

In case of booking outside of six weeks before arrival, the following conditions apply: After RECON ISTRIA receives the booking, guests will receive an invoice by email or by mail. A deposit of 40% must be paid no later than 5 days after booking. Payment will be made by bank transfer to the named bank account. Other payment methods like credit card, PayPal etc. are not offered. The remaining amount must be paid at least six weeks before arrival.

3.2. Bookings within 6 weeks before the start of the rental period

When booking within six weeks before arrival, the full invoice amount must be transferred within 5 days. Payment will be made by bank transfer to the named bank account. Other payment methods like credit card, PayPal etc. are not offered.

3.3. Bookings immediately before the start of the rental (last minute)

When booking immediately, within one week before the start of the rental period, the entire invoice amount is due for payment immediately. In this case, payment must be made by credit card or PayPal. Guests will then receive further information together with the invoice.

3.4. Non-compliance with payment deadlines

The Guest assumes the obligation to make payments within the deadlines defined in this point of the General Terms and Conditions and in the manner explained herein. If the guest does not comply with the payment deadlines, this is a serious breach of contractual obligations. In this case RECON ISTRIA is entitled to terminate the contract without notice.

4. CANCELLATION AND SETTLEMENT

4.1. Cancellation

A concluded rental agreement can only be terminated in text form by email. The termination is effective from the day on which it is received by the contracting party and only under the conditions specified herein.

4.2 Cancellation conditions / termination conditions

In case of cancellation up to six weeks before arrival, 40% of the invoice amount will be charged as cancellation fee. (Example: scheduled arrival is Saturday, 09/24/2022, six weeks before arrival is Saturday, 08/13/2022, cancellation must be received no later than 12/08/2022 by 24:00).

In case of cancellation up to three weeks before arrival, 75% of the invoice amount will be charged as cancellation fee. (Example: planned arrival is Saturday, 24.09.2022, three weeks before arrival is Saturday, 03.09.2022, the cancellation must be received no later than 02.09.2022 by 24:00).

In case of cancellation within 3 weeks before arrival, 100% of the invoice amount will be charged as cancellation fee. (Example: Planned arrival is Saturday, 09/24/2022, three weeks prior to arrival is Saturday, 09/03/2022, cancellations received after 09/03/2022 from 0:00 are received within 3 weeks prior to arrival).

The aforementioned cancellation conditions apply analogously if the contract is cancelled by RECON ISTRIA. In the event of cancellation of the rental agreement, overpayments will be refunded, if applicable.

4.3 Force majeure

If the concluded rental contract cannot be fulfilled by RECON ISTRIA due to force majeure (e.g. war, natural disasters, environmental disasters, epidemic, border closure, strike, etc.) or if the fulfillment of the contract is significantly impeded as a result of force majeure that could not be foreseen at the time of the conclusion of the contract, RECON ISTRIA may terminate the rental contract. Since RECON ISTRIA cannot be held liable for the occurrence of the aforementioned circumstances, the cancellation / termination conditions regulated under 4.2 apply analogously in the event of force majeure.

5. EXISTING DEFECTS AND COMPLAINTS

In case the guest notices any deficiencies in cleaning, damages and other defects of the villa or has any other complaints when taking over the villa, he/she will complain about it immediately, but in any case within 24 hours. The complaint is made directly to RECON ISTRIA or its local representative on site.

The guest is obliged to avert or limit the occurrence of damage according to his possibilities and to contribute to keep any kind of loss for the owner as low as possible.

In case of any kind of complaint, the guest will grant the owner a reasonable period of time to remedy the defect.

Leaving the villa before the expiration of the agreed rental period and without prior notice and agreement is at the risk and expense of the guest, and RECON ISTRIA assumes no liability.

6. DAMAGE

The guest assumes the obligation to use the rented Villa Pietra with care. The guest has to hand over the villa in the found condition. The guest is directly liable to RECON ISTRIA for all damages caused.

The guest will immediately inform the owner about the occurrence of any damage to the villa and the land around the villa within the rental period. Before the departure of the guest and the handover, the guest will visit the villa and the property together with a representative of RECON ISTRIA.

Provided that no damage was caused, RECON ISTRIA will return the deposited deposit to the guest. If any damage has been caused and the guest has insurance, the guest will proceed according to the insurance conditions.

Additional cleaning expenses due to particularly bad condition of the villa after the return by the guest to RECON ISTRIA is also understood as damage, so that RECON ISTRIA can settle this damage from the deposit. An additional cleaning effort to remove pet droppings is also understood as damage in this sense. RECON ISTRIA is entitled to settle the additional cleaning costs with the deposit.

7. JURISDICTION

The contracting parties will try to settle any disputes amicably. The place of jurisdiction is the locally competent court at the registered office of RECON ISTRIA in Croatia, applying Croatian legal norms.
